Tariff Update & 10% Global Surcharge Announcement
We would like to share an important update following the recent 6–3 decision by the Supreme Court of the United States striking down the bulk of former President Donald Trump’s emergency tariffs.
In response to the ruling, President Trump announced during this afternoon’s press conference his intent to immediately implement a 10% global tariff under Section 122 of the Trade Act of 1974.
What Section 122 Allows
Section 122 authorizes the President to impose temporary import surcharges — up to 15% — for a period of up to 150 days without additional congressional approval. This authority is designed for rapid response to balance-of-payments concerns or certain foreign trade practices.
What This Means for Industry
• A 10% across-the-board tariff falls within the statutory limits of Section 122.
• The measure would be temporary unless Congress acts to extend it.
• The surcharge would apply broadly to virtually all importers.
• Importantly, it would be assessed in addition to existing duties under Sections 232 and 301.
• Because Section 122 allows for swift implementation, limited notice or phase-in time should be expected.
At this time, we anticipate additional guidance from U.S. Customs regarding implementation timelines and compliance procedures. Manufacturers should prepare for potential landed cost increases, rapid effective dates, and the need to adjust shipment timing or sourcing strategies accordingly.
